IN NO EVENT SHALL COSTA VIDA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO COSTA VIDA IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).
The limitations of liability set forth above shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or any other legal theory, even if Costa Vida has been advised of the possibility of such damages.
11. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Costa Vida, its owners, officers, directors, employees, agents, licensors, affiliates, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

13. Dispute Resolution and Arbitration

If the parties are unable to resolve a Dispute informally within thirty (30) days, you and Costa Vida agree that any Dispute shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in the English language.
The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could award, except that the arbitrator shall have no authority to award punitive damages unless expressly permitted by applicable law. The arbitrator's decision shall be final and binding, and judgment upon the award may be entered in any court of competent jurisdiction.

13.4 Exception — Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes that qualify under the applicable small claims court rules and jurisdictional limits, provided that the action remains in small claims court and does not seek relief on a class or representative basis.
